terms of service

A binding agreement between you and Toasty Cabin LLC, a North Carolina, USA limited liability company ("whatevr," "we," "us," or "our") — operator of the whatevr app, website, and API (together, "the Service").

Please read these Terms carefully — they include a Not Medical Advice notice, an AI Estimates / No Guarantee of Accuracy disclaimer, a Limitation of Liability cap, and a Binding Arbitration and Class-Action Waiver for U.S. users.

1. Acceptance of these terms

By creating an account, signing in, or otherwise using the Service, you agree to these Terms and to our Privacy Policy, which is incorporated here by reference. If you do not agree, please don't use the Service. If you're using the Service on behalf of another person or organization, you represent that you're authorized to accept these Terms on their behalf.

2. Eligibility — you must be 18 or older

You must be at least 18 years old to use the Service. By using it, you represent that you are 18 or older. If we learn we've collected information from someone under 18, we will delete it. If you believe a minor is using the Service, contact support@trywhatevr.app.

3. What the service does

whatevr lets you:

The Service is available through the web app, our native iOS app, and — where offered — a public API, all powered by the same backend. We may add, change, or remove features over time, and availability isn't guaranteed.

4. Your account

Sign-in. We use passwordless sign-in — you enter your email and we send a one-time code. We do not store passwords. Anyone with access to your email inbox may be able to access your account, so keep it secure.

Accurate information. You agree to provide accurate account information and keep it current.

Your responsibility. You're responsible for activity under your account. Accounts are for individual people — don't share yours or let someone else use it as their own. Notify us promptly at support@trywhatevr.app if you believe your account has been compromised.

We may suspend or terminate accounts that violate these rules (see Section 12).

6. Your content and the license you give us

You own your content. The food, exercise, weight, measurement, and water logs; goals and targets; scores and streaks; voice clips; and any photos you upload (together, "Your Content") belong to you. We don't claim ownership of it.

The limited license you grant us. To operate the Service, you grant us a worldwide, non-exclusive, royalty-free license to host, store, copy, transmit, process, display, and back up Your Content solely to provide, secure, and improve the Service for you. This includes sending relevant parts of Your Content (a food description, voice clip, or photo) to xAI and our infrastructure providers so they can be parsed, transcribed, stored, and returned to you (see Section 10), and showing limited information (your display name, handle, avatar, and cheers) to buddies you connect with.

This license ends when you delete the content or your account, except that we may retain limited residual copies in short-lived operational backups, and we may keep anonymized/aggregated data that doesn't identify you to improve the Service. We do not sell Your Content — see our Privacy Policy for details on data handling and your rights.

Sub-processor handling. Once part of Your Content is transmitted to a third-party provider for processing — for example to xAI for parsing or transcription — that provider's handling and retention of that input is governed by its own terms and our agreement with it, in addition to our own deletion practices. Our Privacy Policy describes what each provider receives.

Feedback. If you send us suggestions or feedback, you grant us the right to use them without restriction or obligation to you.

7. Not medical advice — please read

whatevr is for general informational and educational purposes only. It is not a medical device, and it does not provide medical, nutritional, clinical, or professional health advice.

Nothing in the Service — including AI-generated nutrition estimates, scores, streaks, goals, or targets — is a diagnosis, treatment, or recommendation, and none of it substitutes for advice from a qualified physician, registered dietitian, or other licensed health professional.

You are solely responsible for your own health decisions. Using the Service to inform any health, diet, or fitness choice is entirely at your own risk.

8. AI estimates — no guarantee of accuracy

This is the most important thing to understand about whatevr.

The nutrition values the Service produces — calories, protein, carbs, fat, fiber, sugar, sodium, ingredient breakdowns, and related figures — are AI-generated estimates. They're produced by automated models, including our AI provider xAI (Grok), from your free-text descriptions, photos, or voice input, and are provided "as is," with no guarantee of accuracy, completeness, or reliability.

It's your responsibility to review and sanity-check any estimate before relying on it. We are not liable for consequences of inaccurate AI estimates, to the fullest extent permitted by law (see Sections 13–14).

9. Intellectual property

The Service itself — its software, design, branding, the "whatevr" name and logo, text, graphics, and other materials we provide (excluding Your Content) — is owned by Toasty Cabin LLC or our licensors and protected by intellectual property law. Subject to these Terms, we grant you a limited, personal, non-exclusive, revocable license to use the Service for your own personal, non-commercial use.

To run the Service, we rely on trusted third-party providers that process data on our behalf:

These providers have their own terms and privacy practices; our Privacy Policy describes what each receives and why. We are not responsible for the independent acts or omissions of third parties.

11. Subscriptions and payments

whatevr may offer paid subscription plans purchased through the Apple App Store. Where offered, free trials convert to a paid subscription unless cancelled at least 24 hours before the trial ends, and subscriptions renew automatically at the price shown until cancelled in your App Store account settings. Billing, renewals, refunds, and cancellations are handled by Apple under the App Store's terms. We will not charge you for paid features without your clear consent, and pricing is shown in the app before you subscribe.

12. Termination and your right to delete your account

You can leave anytime. Delete your account from within the app (Settings → Account → Delete Account) — this triggers an immediate, full cascade-delete of your personal data from our active systems, as described in our Privacy Policy. An in-app JSON export is available if you want a copy of your data first.

We may suspend or terminate your access if you violate these Terms, create risk or legal exposure for us or others, or if we discontinue the Service. Where reasonable and lawful, we'll try to give you notice.

To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless Toasty Cabin LLC and its officers, members, employees, and agents from third-party claims, liabilities, damages, and expenses (including reasonable legal fees) arising from: (a) your misuse of the Service; (b) Your Content; (c) your violation of these Terms or any law; or (d) your violation of any third party's rights. This indemnity applies only to the extent a claim arises from your own acts, omissions, or content, and does not apply to the extent a loss is caused by our own conduct.

16. Binding arbitration and class-action waiver (U.S. users)

Please read this section carefully — it affects your legal rights. It applies to users in the United States.

In plain English: instead of going to court, you and whatevr agree to resolve most disputes through individual binding arbitration — a private process before a neutral arbitrator rather than a judge or jury. You also give up the right to participate in a class action.

If this section is found unenforceable in whole or in part, the rest of these Terms still apply, and any claim that cannot be arbitrated will be resolved in the courts identified in Section 17.

17. Governing law

These Terms are governed by the laws of the State of North Carolina, USA, without regard to its conflict-of-laws rules. Subject to Section 16 (Arbitration), any dispute not subject to arbitration will be brought exclusively in the state or federal courts located in North Carolina, and you consent to their jurisdiction.

18. Changes to these terms

We may update these Terms from time to time. If we make material changes, we'll take reasonable steps to notify you (in-app or by email) and update the "last updated" date above. Continued use of the Service after changes take effect means you accept the updated Terms. If you don't agree, please stop using the Service and delete your account.
