terms of service

A binding agreement between you and Toasty Cabin LLC, a North Carolina, USA limited liability company ("whatevr," "we," "us," or "our") — operator of the whatevr app, website, and API (together, "the Service").

Please read these Terms carefully — they include a Not Medical Advice notice, an AI Estimates / No Guarantee of Accuracy disclaimer, a Limitation of Liability cap, and a Binding Arbitration and Class-Action Waiver for U.S. users.

1. Acceptance of these terms

By creating an account, signing in, or otherwise using the Service, you agree to these Terms and to our Privacy Policy, which is incorporated here by reference. If you do not agree, please don't use the Service. If you're using the Service on behalf of another person or organization, you represent that you're authorized to accept these Terms on their behalf.

2. Eligibility — you must be 18 or older

You must be at least 18 years old to use the Service. By using it, you represent that you are 18 or older. If we learn we've collected information from someone under 18, we will delete it. If you believe a minor is using the Service, contact support@trywhatevr.app.

3. What the service does

whatevr lets you:

Log food in plain language or by photo and have it parsed by AI into calories and macros with ingredient breakdowns;
Log exercise, weight, body measurements, and water intake;
Use voice input — short audio clips transcribed to text so you can log hands-free;
Set calorie/macro goals and targets, and track body metrics;
See daily scores and streaks;
Connect with buddies and send or receive cheers.

The Service is available through the web app, our native iOS app, and — where offered — a public API, all powered by the same backend. We may add, change, or remove features over time, and availability isn't guaranteed.

4. Your account

Sign-in. We use passwordless sign-in — you enter your email and we send a one-time code. We do not store passwords. Anyone with access to your email inbox may be able to access your account, so keep it secure.

Accurate information. You agree to provide accurate account information and keep it current.

Your responsibility. You're responsible for activity under your account. Accounts are for individual people — don't share yours or let someone else use it as their own. Notify us promptly at support@trywhatevr.app if you believe your account has been compromised.

5. Acceptable use

You agree not to:

Use the Service if you're under 18, or misrepresent your age or identity;
Break the law, infringe anyone's rights, or use the Service for any unlawful or harmful purpose;
Upload content that's illegal, abusive, harassing, hateful, sexually explicit, or that violates someone else's privacy or intellectual property;
Impersonate anyone, or misuse buddy connections or cheers to harass or spam others;
Upload photos of other people without their consent;
Access accounts, data, or systems that aren't yours, or probe/test the security of the Service without authorization;
Reverse engineer, scrape, or build a competing product from the Service, except where prohibited by law;
Introduce malware, overload the Service, or circumvent rate limits or security features;
Use automated means to access the Service except through interfaces we provide (such as a documented API).

We may suspend or terminate accounts that violate these rules (see Section 12).

6. Your content and the license you give us

You own your content. The food, exercise, weight, measurement, and water logs; goals and targets; scores and streaks; voice clips; and any photos you upload (together, "Your Content") belong to you. We don't claim ownership of it.

The limited license you grant us. To operate the Service, you grant us a worldwide, non-exclusive, royalty-free license to host, store, copy, transmit, process, display, and back up Your Content solely to provide, secure, and improve the Service for you. This includes sending relevant parts of Your Content (a food description, voice clip, or photo) to xAI and our infrastructure providers so they can be parsed, transcribed, stored, and returned to you (see Section 10), and showing limited information (your display name, handle, avatar, and cheers) to buddies you connect with.

This license ends when you delete the content or your account, except that we may retain limited residual copies in short-lived operational backups, and we may keep anonymized/aggregated data that doesn't identify you to improve the Service. We do not sell Your Content — see our Privacy Policy for details on data handling and your rights.

Sub-processor handling. Once part of Your Content is transmitted to a third-party provider for processing — for example to xAI for parsing or transcription — that provider's handling and retention of that input is governed by its own terms and our agreement with it, in addition to our own deletion practices. Our Privacy Policy describes what each provider receives.

Feedback. If you send us suggestions or feedback, you grant us the right to use them without restriction or obligation to you.

7. Not medical advice — please read

whatevr is for general informational and educational purposes only. It is not a medical device, and it does not provide medical, nutritional, clinical, or professional health advice.

Nothing in the Service — including AI-generated nutrition estimates, scores, streaks, goals, or targets — is a diagnosis, treatment, or recommendation, and none of it substitutes for advice from a qualified physician, registered dietitian, or other licensed health professional.

Always consult a qualified professional before making decisions about your diet, exercise, supplements, medication, or health — especially if you have a medical condition (including diabetes, an eating disorder or history of disordered eating, kidney or heart disease, or an allergy), are pregnant or nursing, or are taking medication.
Never disregard or delay professional medical advice because of something you saw in whatevr.
If you think you may have a medical emergency, call your doctor or local emergency number immediately.

You are solely responsible for your own health decisions. Using the Service to inform any health, diet, or fitness choice is entirely at your own risk.

8. AI estimates — no guarantee of accuracy

This is the most important thing to understand about whatevr.

The nutrition values the Service produces — calories, protein, carbs, fat, fiber, sugar, sodium, ingredient breakdowns, and related figures — are AI-generated estimates. They're produced by automated models, including our AI provider xAI (Grok), from your free-text descriptions, photos, or voice input, and are provided "as is," with no guarantee of accuracy, completeness, or reliability.

AI estimates can be wrong — sometimes significantly. Portion sizes are guessed, photos can be misread, and real food varies from any estimate.
These numbers are not a substitute for laboratory analysis, verified nutrition labels, or professional dietary assessment.
You must not rely on these estimates for any medical, clinical, or health-critical decision — including insulin or medication dosing, managing an allergy, or any decision where an inaccurate number could harm you. For those decisions, rely only on verified sources and your healthcare provider.
Voice transcription and photo recognition are likewise automated and performed by xAI — either may misinterpret what you said or showed.

It's your responsibility to review and sanity-check any estimate before relying on it. We are not liable for consequences of inaccurate AI estimates, to the fullest extent permitted by law (see Sections 13–14).

9. Intellectual property

The Service itself — its software, design, branding, the "whatevr" name and logo, text, graphics, and other materials we provide (excluding Your Content) — is owned by Toasty Cabin LLC or our licensors and protected by intellectual property law. Subject to these Terms, we grant you a limited, personal, non-exclusive, revocable license to use the Service for your own personal, non-commercial use.

10. Third-party services (sub-processors)

To run the Service, we rely on trusted third-party providers that process data on our behalf:

Apple	Sign-in, subscriptions/billing, push notification delivery to the iOS app (Apple Push Notification service), and Health sync (iOS, opt-in)
Web push services	Delivering push notifications you enable

These providers have their own terms and privacy practices; our Privacy Policy describes what each receives and why. We are not responsible for the independent acts or omissions of third parties.

11. Subscriptions and payments

whatevr may offer paid subscription plans purchased through the Apple App Store. Where offered, free trials convert to a paid subscription unless cancelled at least 24 hours before the trial ends, and subscriptions renew automatically at the price shown until cancelled in your App Store account settings. Billing, renewals, refunds, and cancellations are handled by Apple under the App Store's terms. We will not charge you for paid features without your clear consent, and pricing is shown in the app before you subscribe.

12. Termination and your right to delete your account

You can leave anytime. Delete your account from within the app (Settings → Account → Delete Account) — this triggers an immediate, full cascade-delete of your personal data from our active systems, as described in our Privacy Policy. An in-app JSON export is available if you want a copy of your data first.

We may suspend or terminate your access if you violate these Terms, create risk or legal exposure for us or others, or if we discontinue the Service. Where reasonable and lawful, we'll try to give you notice.

Sections that by their nature should survive termination — including 6 (license to residual/anonymized data), 7, 8, 9, 13, 14, 15, 16, and 17 — survive.

13. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, TOASTY CABIN LLC AND ITS SUPPLIERS DISCLAIM ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY AI-GENERATED ESTIMATE, TRANSCRIPTION, SCORE, OR OTHER OUTPUT WILL BE ACCURATE, COMPLETE, OR RELIABLE. ANY HEALTH, DIET, OR FITNESS DECISIONS YOU MAKE BASED ON THE SERVICE ARE MADE AT YOUR OWN RISK. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.

14. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW: TOASTY CABIN LLC AND ITS OFFICERS, MEMBERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS — INCLUDING DAMAGES ARISING FROM INACCURATE AI ESTIMATES — EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

15. Indemnification

To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless Toasty Cabin LLC and its officers, members, employees, and agents from third-party claims, liabilities, damages, and expenses (including reasonable legal fees) arising from: (a) your misuse of the Service; (b) Your Content; (c) your violation of these Terms or any law; or (d) your violation of any third party's rights. This indemnity applies only to the extent a claim arises from your own acts, omissions, or content, and does not apply to the extent a loss is caused by our own conduct.

16. Binding arbitration and class-action waiver (U.S. users)

Please read this section carefully — it affects your legal rights. It applies to users in the United States.

In plain English: instead of going to court, you and whatevr agree to resolve most disputes through individual binding arbitration — a private process before a neutral arbitrator rather than a judge or jury. You also give up the right to participate in a class action.

Agreement to arbitrate. Any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, governed by the Federal Arbitration Act. Judgment on the award may be entered in any court with jurisdiction.
Where. Unless agreed otherwise, arbitration is seated in North Carolina, USA, and may be conducted by document submission, phone, or video where AAA rules allow.
Fees. Allocation of arbitration fees is governed by the AAA Consumer Arbitration Rules, which place most costs on the business for consumer claims.
Class-action waiver. You and whatevr agree that each may bring claims only in an individual capacity, not as a plaintiff or class member in any class, collective, or representative proceeding.
Exceptions. Either party may bring an individual claim in small-claims court if it qualifies, and seek injunctive relief in court for intellectual-property or unauthorized-access matters.
Opting out. You may opt out of this arbitration agreement by emailing support@trywhatevr.app within 30 days of first accepting these Terms, with your name and a clear statement that you wish to opt out. Opting out won't affect any other part of these Terms.

If this section is found unenforceable in whole or in part, the rest of these Terms still apply, and any claim that cannot be arbitrated will be resolved in the courts identified in Section 17.

17. Governing law

These Terms are governed by the laws of the State of North Carolina, USA, without regard to its conflict-of-laws rules. Subject to Section 16 (Arbitration), any dispute not subject to arbitration will be brought exclusively in the state or federal courts located in North Carolina, and you consent to their jurisdiction.

18. Changes to these terms

We may update these Terms from time to time. If we make material changes, we'll take reasonable steps to notify you (in-app or by email) and update the "last updated" date above. Continued use of the Service after changes take effect means you accept the updated Terms. If you don't agree, please stop using the Service and delete your account.

19. General

Entire agreement. These Terms and our Privacy Policy are the entire agreement between you and us about the Service.
Severability. If any provision is found unenforceable, the rest remains in effect.
No waiver. Our failure to enforce a provision is not a waiver of it.
Assignment. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
Apple App Store. If you use our iOS app, these Terms are between you and whatevr (not Apple); Apple has no obligation to provide support, and Apple is a third-party beneficiary entitled to enforce the relevant App Store terms.
